ELECTRONIC SIGNATURE DISCLOSURE

By signing this agreement electronically, you agree that:

1. Your electronic signature has the same legal effect as a handwritten signature under the California Uniform Electronic Transactions Act (CUETA) and federal E-SIGN Act.
2. You consent to conduct this transaction electronically.
3. You have the ability to download, print, or save this agreement for your records.
4. You may request a paper copy by emailing admin@strikerscricket.com

1. PARTICIPANT INFORMATION

This consent applies to the following participant:

2. GRANT OF RIGHTS

I, the undersigned parent or legal guardian, hereby grant to Strikers Cricket Academy, its owners, employees, coaches, volunteers, contractors, agents, licensees, successors, and assigns (collectively, “Strikers”) the following rights:

2.1 Right to Capture Media

The irrevocable, perpetual right and permission to photograph, videotape, audio record, or otherwise capture images, video, audio, or likeness of my child (collectively, “Media”) during:

• Training sessions and practices
• Games, matches, and tournaments
• Special events, camps, and workshops
• Award ceremonies and celebrations
• Promotional events and photo shoots
• Any other Strikers Cricket Academy activities or events

2.2 Right to Use Media

The irrevocable, perpetual, worldwide, royalty-free, fully-paid right and license to use, reproduce, modify, adapt, publish, distribute, publicly display, publicly perform, create derivative works from, and otherwise exploit the Media in any manner, form, or medium, whether now known or hereafter developed, including but not limited to:

2.3 Right to Use Identifying Information

The right to use my child's:

• First name and last name (or first name only at Strikers' discretion)
• Age or age group
• Team or program level
• Achievements, awards, or accomplishments
• Hometown or general location (e.g., “Bay Area”)
• Quotes or statements made by my child

2.4 Right to Modify

The right to crop, edit, alter, or modify the Media in any manner Strikers deems appropriate, including but not limited to:

• Cropping or resizing images
• Adjusting color, brightness, or contrast
• Adding text, graphics, or overlays
• Creating composite images or videos
• Adding background music or narration
• Editing for length or content

2.5 Commercial Use

The right to use the Media for commercial purposes, including but not limited to:

• Paid advertising campaigns
• Promotional materials designed to attract new students
• Sponsorship presentations
• Marketing to corporate partners or donors
• Merchandise sales
• Revenue-generating content

3. DURATION AND SCOPE

3.1 Perpetual License

This consent grants rights in perpetuity, meaning:

• There is no expiration date for this consent
• Rights continue even after my child's participation in Strikers programs ends
• Rights survive even if this consent is later revoked (for media already captured)

3.2 Worldwide Scope

This consent grants worldwide rights, meaning:

• Media may be used in any country or territory
• Media may be used across international borders
• Media may be translated or adapted for different markets

3.3 Transferable Rights

Strikers may:

• License or sublicense these rights to third parties
• Assign these rights to successors or affiliated organizations
• Allow partners, sponsors, or media outlets to use the Media
• Include the Media in content distributed or published by others

4. LIMITATIONS AND RESTRICTIONS

4.1 What Strikers Will NOT Do

Strikers agrees to use Media in a manner that:

• Does not portray my child in a false, defamatory, or offensive manner
• Does not associate my child with inappropriate, offensive, or adult content
• Respects my child's dignity and privacy to the extent reasonable
• Does not use my child's full name and address together in publicly accessible content

4.2 No Obligation to Use

Strikers has no obligation to:

• Use any Media of my child
• Provide copies of Media to me
• Notify me before using Media
• Credit or attribute Media to my child

4.3 No Review or Approval

I understand that:

• I will not have the right to review or approve Media before use
• I will not have the right to approve specific uses or placements
• Strikers has sole discretion over how and when to use Media

5. WAIVER OF RIGHTS AND COMPENSATION

5.1 No Compensation

I acknowledge and agree that:

• Neither I nor my child will receive any compensation, payment, or royalties for the use of Media
• This consent is given without expectation of payment or other consideration
• The opportunity for my child to participate in Strikers programs is sufficient consideration for this consent

5.2 Waiver of Ownership Rights

I acknowledge that:

• Strikers owns all rights, title, and interest in any Media it creates
• Neither I nor my child will have any ownership rights in such Media
• I waive any moral rights or artist's rights I may have in the Media

5.3 Release of Claims

I, on behalf of myself and my child, release and discharge Strikers from any and all claims, demands, or causes of action that I or my child may have arising from the use of Media, including but not limited to:

• Claims for invasion of privacy
• Claims for violation of right of publicity
• Claims for defamation or misrepresentation
• Claims for copyright or intellectual property infringement
• Claims for emotional distress
• Claims for any other legal theory

6. CALIFORNIA-SPECIFIC PROVISIONS

6.1 California Civil Code Section 3344

I acknowledge that California Civil Code Section 3344 provides rights regarding the commercial use of name, voice, signature, photograph, or likeness. I voluntarily waive these rights with respect to Strikers' use of Media as described in this consent.

6.2 Minors' Rights

I acknowledge that:

• As a parent or guardian, I have the legal authority to grant this consent on behalf of my minor child
• Under California law, my child may have independent rights upon reaching age 18
• My child may choose to revoke or limit this consent upon reaching majority, but such revocation will not affect Media already captured or used

6.3 Right to Revoke (Future Media Only)

While this consent is perpetual for Media already captured, I understand that I may revoke this consent for FUTURE media by:

• Sending written notice to admin@strikerscricket.com
• Providing at least 14 days' notice
• Understanding that revocation applies only to media captured AFTER the effective date of revocation
• Understanding that Strikers may continue to use any Media captured before revocation

7. MEDIA CAPTURED BY THIRD PARTIES

7.1 Third-Party Photographers

I understand that Strikers may hire professional photographers or videographers to capture Media at events. By granting this consent, I authorize:

• Such third parties to capture Media of my child on Strikers' behalf
• Strikers to receive and use such Media as if Strikers had captured it directly
• Such third parties to use Media in their own portfolios with Strikers' permission

7.2 Media at Public Events

I understand that events may occur in public or semi-public spaces where:

• News media or other third parties may be present
• Other parents or spectators may capture photos or videos
• This consent does not control use of Media by unaffiliated third parties

8. SPECIAL REQUESTS AND OPT-OUT OPTIONS

8.1 Complete Opt-Out

If you do NOT wish to grant any of the rights in this consent, you may:

• Decline this consent during enrollment (check the opt-out box)
• Notify Strikers in writing at any time at admin@strikerscricket.com
• Continue participation in all Strikers programs (opt-out does not affect eligibility)

8.2 Limited Opt-Out Options

If you wish to grant limited consent, please contact admin@strikerscricket.com to discuss options such as:

• Consent for website use only (no social media)
• Consent for first name only (no last name)
• Consent for group photos only (no individual photos)
• Other custom arrangements

Please note: Limited consents require manual processing and may not always be feasible.

8.3 Requesting Removal of Specific Media

If specific Media has been posted that you wish to have removed, you may:

• Contact admin@strikerscricket.com with details (URL, platform, date posted)
• We will review your request and respond within 14 business days
• We will make reasonable efforts to remove Media from channels we control
• We cannot remove Media that has been shared, redistributed, or republished by third parties

9. PRIVACY AND DATA PROTECTION

9.1 How Media Is Stored

Strikers stores Media:

• On secure servers and cloud storage platforms
• With access limited to authorized staff and contractors
• In accordance with reasonable security practices
• For an indefinite period of time

9.2 Sharing with Third Parties

Strikers may share Media with:

• Professional photographers, videographers, or designers working on Strikers' behalf
• Marketing agencies or consultants
• Sponsors or partners (with appropriate permissions)
• Media outlets for publicity purposes
• Social media platforms and website hosting services

9.3 Your Privacy Rights

Under California law (CCPA), you have certain rights regarding personal information, including images of your child. You may:

• Request information about what Media we have of your child
• Request deletion of Media (subject to exceptions)
• Opt out of “sale” of personal information (Strikers does not sell Media)

10. GENERAL PROVISIONS

10.1 Entire Agreement

This consent constitutes the entire agreement between me and Strikers regarding use of Media and supersedes any prior agreements or understandings.

10.2 Modification

Strikers may update this consent from time to time. Updated versions will be posted at strikersacademy.org. Continued participation after updates are posted constitutes acceptance of updated terms.

10.3 Severability

If any provision of this consent is found to be unenforceable or invalid, such provision shall be severed, and the remaining provisions shall remain in full force and effect.

10.4 Governing Law

This consent shall be governed by and construed in accordance with the laws of the State of California.

10.5 No Third-Party Beneficiaries

This consent is solely for the benefit of Strikers and me, and does not create any rights for third parties.

11. ACKNOWLEDGMENT OF UNDERSTANDING

I HAVE CAREFULLY READ THIS PHOTO AND VIDEO CONSENT AND FULLY UNDERSTAND ITS CONTENTS. I understand that:

• I am granting Strikers broad rights to use photos and videos of my child
• These rights are perpetual and worldwide
• Strikers may use Media for commercial purposes without compensating me
• I will not have the right to review or approve Media before use
• I can opt out of this consent without affecting my child's participation
• I can request removal of specific Media but Strikers is not obligated to comply
• My child may have independent rights upon reaching age 18
• I am signing this document of my own free will

By clicking “I Agree” or signing electronically, I grant the rights described in this Photo, Video, and Media Release Consent.
