This is a legal document that affects your rights. By agreeing to this waiver, you are waiving certain legal rights, including the right to sue for injuries or damages, except in cases of gross negligence or willful misconduct.

2. DEFINITION OF ACTIVITIES
“Activities” means all cricket-related programs, training sessions, practices, games, matches, tournaments, events, travel, and any other activities organized, sponsored, supervised, or facilitated by Strikers Cricket Academy, whether conducted:
- At Strikers Cricket Academy facilities
- At third-party facilities or venues
- During indoor or outdoor training
- During competitive matches or tournaments
- During travel to or from any Activity (when provided by Strikers)
- During special events, camps, or workshops
3. ACKNOWLEDGMENT OF INHERENT RISKS
I, the undersigned parent or legal guardian, acknowledge and understand that participation in cricket and related Activities involves inherent and significant risks of serious bodily injury, including but not limited to:
Physical Injury Risks:
- Impact injuries from cricket balls traveling at high speeds (potentially 60+ mph)
- Head and facial injuries including concussions, traumatic brain injury, eye injuries, dental injuries, and facial fractures
- Hand and finger injuries including fractures, dislocations, and crush injuries
- Musculoskeletal injuries including sprains, strains, torn ligaments, broken bones, and joint injuries
- Collision injuries with other participants, equipment, boundary markers, or facility structures
- Overuse injuries from repetitive motions in bowling, batting, or fielding
Environmental and Facility Risks:
- Weather-related hazards including heat illness, dehydration, sunburn, lightning strikes
- Playing surface hazards including uneven ground, wet surfaces, holes, or debris
- Equipment failure or malfunction
- Facility hazards including doors, walls, fencing, or other structures
Other Risks:
- Allergic reactions to insects, grass, or other environmental factors
- Communicable diseases from contact with other participants
- Pre-existing condition aggravation
- Permanent disability or death in extreme circumstances
Acknowledged Risk Factors:
I understand that these risks exist even when:
- Participants wear required protective equipment (helmets, pads, gloves, guards)
- Professional coaching and supervision are provided
- Safety rules, protocols, and guidelines are established and followed
- Facilities, equipment, and playing surfaces are properly inspected and maintained
- Weather conditions are monitored
- First aid and emergency procedures are in place
I further acknowledge that:
- The above list is not exhaustive
- Other risks, both foreseen and unforeseen, may result in injury, illness, or harm
- Cricket balls are hard and can cause serious injury upon impact
- Cricket bats are heavy and can cause injury if swung improperly or if contact occurs
- Competitive play may increase risk due to speed and intensity of play
- My child's skill level, physical condition, and behavior affect risk levels
4. ASSUMPTION OF RISK
I, on behalf of myself and my child, knowingly, voluntarily, and willingly assume all risks associated with my child's participation in the Activities, including but not limited to risks that may arise from or be caused by:
- Actions of Released Parties: The actions, inactions, errors, omissions, or negligence (but not gross negligence or willful misconduct) of Strikers Cricket Academy, its owners, directors, officers, employees, coaches, volunteers, contractors, or agents (collectively, “Released Parties”)
- Actions of Other Participants: The actions, inactions, or negligence of other participants in the Activities
- Facility and Equipment Conditions: The condition, design, or maintenance of facilities, equipment, playing surfaces, or premises used for Activities
- Rules and Coaching Decisions: The rules of cricket, coaching methods, team selection decisions, or playing time decisions
- Participant's Own Actions: My child's own actions, inactions, physical condition, skill level, or failure to follow instructions
- Travel: Travel to and from Activities (when not provided by Strikers Cricket Academy)
- Weather and Environmental Factors: Weather conditions, temperature, humidity, or other environmental factors
I accept personal financial and legal responsibility for any damages, injuries, or losses that may result from my child's participation in the Activities.
5. RELEASE AND WAIVER OF LIABILITY
In consideration of my child being permitted to participate in the Activities, I hereby, for myself, my child, and on behalf of my heirs, executors, administrators, successors, and assigns:
5.1 Release and Discharge
RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the Released Parties from any and all liabilities, claims, demands, actions, causes of action, damages, losses, costs, or expenses of any nature whatsoever, whether known or unknown, foreseen or unforeseen, that I or my child may have or may hereafter accrue relating to or arising from my child's participation in the Activities.
5.2 Scope of Release
This release applies to claims or liabilities:
- For personal injury, bodily injury, illness, disease, death, or property damage
- Arising from any cause whatsoever, INCLUDING NEGLIGENCE of the Released Parties
- Whether occurring before, during, or after participation in Activities
- Whether arising from breach of contract, breach of duty, negligence, or any other legal theory
5.3 Exceptions
This release does NOT apply to:
- Claims arising from GROSS NEGLIGENCE, reckless conduct, or willful misconduct of the Released Parties
- Claims that cannot be waived under California law
- Claims for damages caused by intentional acts of the Released Parties
6. INDEMNIFICATION AND HOLD HARMLESS
I agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from and against any and all:
- Claims or Lawsuits: Any claims, demands, lawsuits, or legal proceedings brought by me, my child, or anyone acting on behalf of me or my child
- Third-Party Claims: Any claims brought by third parties arising from my child's actions or participation in Activities
- Costs and Expenses: All costs, expenses, damages, liabilities, settlements, and judgments, including reasonable attorneys' fees and court costs
- Property Damage: Any damage to property caused by my child's actions or negligence
This indemnification obligation applies even if the claim arises in whole or in part from the negligence of the Released Parties, except for claims arising from gross negligence or willful misconduct.
7. MEDICAL TREATMENT AND INSURANCE
7.1 Medical Authorization
I hereby authorize Strikers Cricket Academy staff and coaches to:
- Assess my child's injuries or medical condition
- Provide or arrange for basic first aid treatment
- Call emergency medical services (911) if needed
- Transport my child to a medical facility for treatment
- Share my child's emergency contact information with medical personnel
- Make emergency medical decisions if I cannot be reached
7.2 Medical Information
I agree to:
- Provide accurate emergency contact information
- Disclose any medical conditions, allergies, medications, or physical limitations that may affect my child's safe participation
- Update Strikers Cricket Academy immediately if my child's medical status changes
- Inform coaches before each session if my child is recovering from illness or injury
7.3 Medical Expenses and Insurance
I understand and acknowledge that:
- Strikers Cricket Academy does not provide medical or health insurance for participants
- I am solely responsible for all medical expenses incurred as a result of my child's participation, including emergency treatment, hospitalization, rehabilitation, or follow-up care
- I should maintain adequate health insurance coverage for my child
- I should verify that my health insurance covers sports-related injuries
- Strikers Cricket Academy is not responsible for any costs associated with medical treatment
8. PARTICIPANT RESPONSIBILITIES AND CONDUCT
8.1 Safety Compliance
My child agrees to:
- Follow all safety rules, instructions, and guidelines provided by coaches and staff
- Wear all required protective equipment during Activities (helmet, pads, gloves, appropriate footwear)
- Inspect equipment before use and report any defects or damage immediately
- Warm up properly before Activities and cool down afterward
- Stay hydrated and take breaks as needed
- Report any injuries, unsafe conditions, or hazards immediately to coaching staff
- Not participate if feeling ill, injured, or physically unable to safely participate
8.2 Conduct Standards
My child agrees to:
- Behave in a respectful, sportsmanlike manner toward coaches, staff, other participants, and opponents
- Follow the Strikers Cricket Academy Code of Conduct
- Not engage in bullying, harassment, or unsportsmanlike behavior
- Not use profane, abusive, or disrespectful language
- Respect facility rules and property
- Not use alcohol, tobacco, or illegal substances before or during Activities
8.3 Removal from Activities
I understand that Strikers Cricket Academy reserves the right to remove my child from Activities, without refund, if my child:
- Violates safety rules or policies
- Engages in inappropriate or disruptive behavior
- Poses a safety risk to themselves or others
- Fails to follow coach instructions
- Is deemed by staff to be unable to safely participate
9. CALIFORNIA-SPECIFIC PROVISIONS
9.1 Minors' Rights Under California Law
I acknowledge and understand that under California law:
- As a parent or guardian, I cannot waive my minor child's right to bring a claim for injuries after the child reaches the age of 18
- This waiver applies only to claims brought by me as parent or guardian during my child's minority
- My child may have the right to pursue legal action upon reaching majority age
- This limitation does not affect the validity or enforceability of other provisions of this waiver
9.2 California Civil Code Section 1542 Waiver
I expressly waive and release any rights I may have under California Civil Code Section 1542, which states:
“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
I understand that this means I am releasing unknown and unsuspected claims as well as known claims.
9.3 Limitations on Waiver
I understand that this waiver does not apply to:
- Claims arising from gross negligence, reckless conduct, or intentional misconduct
- Claims for damages that cannot be waived under California law
- Violations of California consumer protection laws
- Fraud or intentional misrepresentation
9.4 Insurance Disclosure
I acknowledge that Strikers Cricket Academy may maintain general liability insurance, but:
- Such insurance does not constitute an admission of liability
- Insurance coverage is not a guarantee of compensation for injuries
- I should not rely on Strikers' insurance and should maintain my own adequate coverage
10. PARENT/GUARDIAN OBLIGATIONS
As the parent or legal guardian, I agree to:
- Supervision: Understand that Strikers Cricket Academy provides supervision only during scheduled Activities and that I am responsible for my child before and after Activities
- Pick-up/Drop-off: Ensure my child is picked up promptly at the end of Activities
- Communication: Respond promptly to communications from Strikers Cricket Academy regarding my child
- Compliance: Ensure my child complies with all rules, policies, and instructions
- Financial Responsibility: Pay all fees and charges as agreed in the Payment Terms
- Accurate Information: Provide truthful and complete information about my child's medical conditions, allergies, and emergency contacts
11. GENERAL PROVISIONS
11.1 Entire Agreement
This waiver, together with the Payment Terms and Photo/Video Consent, constitutes the entire agreement between me and Strikers Cricket Academy regarding liability and supersedes any prior oral or written agreements.
11.2 Modification
This waiver may only be modified in writing and signed by both parties. Strikers Cricket Academy may update this waiver from time to time, and continued participation constitutes acceptance of updated terms.
11.3 Severability
If any provision of this waiver is found to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall remain in full force and effect.
11.4 Waiver of Provisions
The failure of Strikers Cricket Academy to enforce any provision of this waiver shall not constitute a waiver of that or any other provision.
11.5 Binding Effect
This waiver shall be binding upon me, my child, and our respective heirs, executors, administrators, successors, and assigns.
11.6 Governing Law
This waiver shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
11.7 Jurisdiction and Venue
Any legal action, suit, or proceeding arising out of or relating to this waiver or my child's participation in Activities shall be brought exclusively in the state or federal courts located in Santa Clara County, California. I consent to the jurisdiction of such courts and waive any objection to venue in such courts.
11.8 Interpretation
This waiver shall be interpreted as broadly as possible to provide maximum protection to the Released Parties within the limits of applicable law.
12. ACKNOWLEDGMENT OF UNDERSTANDING
I HAVE CAREFULLY READ THIS WAIVER AND FULLY UNDERSTAND ITS CONTENTS. I understand that:
- This is a legal document that affects my legal rights
- I am waiving the right to sue for injuries except in cases of gross negligence or willful misconduct
- I am assuming all risks associated with my child's participation in cricket
- I am agreeing to indemnify and hold harmless Strikers Cricket Academy
- I am agreeing to be responsible for all medical expenses
- My child retains the right to sue upon reaching age 18 under California law
- I have had the opportunity to ask questions and seek legal advice
- I am signing this document of my own free will without any pressure or coercion
