IMPORTANT NOTICE

READ CAREFULLY BEFORE AGREEING

This is a binding agreement that requires your child to represent Strikers Cricket Academy exclusively while enrolled as a member. Players who train at Strikers may not simultaneously compete for or represent another cricket club or academy.

This commitment is fundamental to how our academy operates. We invest significant coaching time, tournament planning, and team-building into every player. That investment only works when players are fully committed to this team.

2. EXCLUSIVITY COMMITMENT

2.1 Exclusive Representation

I, the undersigned parent or legal guardian, agree that while my child is enrolled as a member of Strikers Cricket Academy, my child shall train with and represent Strikers Cricket Academy exclusively. My child shall not simultaneously be a member of, train with, compete for, or represent any other cricket club, academy, or organized cricket program.

2.2 Definition of “Representing Another Club”

For the purposes of this agreement, “representing another club” means any of the following activities performed under the name, banner, affiliation, or sponsorship of another cricket club, academy, or organized cricket program:

  • Competing in tournaments organized by or on behalf of another club, league, or cricket organization
  • Playing in league matches as a rostered or guest player for another club or team
  • Participating in organized competitive matches (including friendly fixtures, inter-club matches, or exhibition games) under another club's name
  • Training regularly with another organized cricket academy, club, or competitive coaching program
  • Being listed on another club's roster as an active player, whether or not the player actually competes
  • Wearing another club's uniform or jersey in any competitive or organized match setting

2.3 What Is Permitted (Not Considered a Violation)

The following activities are expressly permitted and do NOT constitute a violation of this exclusivity commitment:

  • Casual or recreational play with friends — informal backyard cricket, park games, or pickup matches that are not organized under any club's name
  • School team participation — playing for your child's school cricket team (elementary, middle, or high school) as part of the school's official athletic program
  • Family or community events — participating in one-off community cricket events, charity matches, or family cricket days not affiliated with a competing club
  • Individual coaching — receiving occasional private coaching from an independent coach for supplemental skill development (not affiliated with a competing club or academy)
  • National or state representative programs — participating in selection trials or representative programs organized by USA Cricket, state cricket associations, or equivalent governing bodies (players must notify Strikers in advance)

2.4 Scope of This Commitment

This exclusivity commitment applies specifically to organized, competitive cricket clubs and academies. It is not intended to restrict your child's ability to enjoy recreational cricket, participate in school athletics, or pursue representative opportunities with governing bodies. The spirit of this policy is simple: players who train here represent Strikers — in practice, in matches, and in tournaments.


3. NOTIFICATION OBLIGATIONS

3.1 Duty to Notify

I agree to promptly notify Strikers Cricket Academy if my child:

  • Receives an invitation, offer, or request to play for, train with, or represent another cricket club, academy, or organization
  • Is approached by coaches, managers, or representatives of other cricket organizations about joining their program
  • Is selected or invited to participate in any representative cricket program, selection trial, or state/national squad
  • Is considering leaving Strikers to join another cricket program

3.2 How to Notify

Notification must be provided by:

  • Emailing admin@strikerscricket.com with details of the invitation or opportunity
  • Providing the name of the organization, the nature of the opportunity, and any relevant dates or timelines
  • Notifying Strikers as soon as reasonably possible, and in any event before the player participates in any activity with the other organization

3.3 Strikers' Response

Upon receiving notification, Strikers will:

  • Review the opportunity and determine whether it constitutes a conflict with this exclusivity commitment
  • Respond within 7 business days with a determination
  • Work in good faith with the family to find a resolution where possible (for example, granting permission for a one-off guest appearance in a non-competing context)

4. DETERMINING VIOLATIONS

4.1 Academy's Sole Discretion

Strikers Cricket Academy shall have sole and absolute discretion in determining whether a player's activities constitute a violation of this exclusivity commitment. This includes, but is not limited to, determining:

  • Whether a particular organization qualifies as a competing cricket club or academy
  • Whether specific activities constitute “representing” another organization
  • Whether an activity falls within the permitted exceptions listed in Section 2.3
  • Whether a player's conduct is consistent with the spirit and intent of this agreement

4.2 Evidence of Violation

Evidence of a violation may include, but is not limited to:

  • The player appearing on another club's roster, team sheet, or official lineup
  • Photographs, videos, or social media posts showing the player competing in another club's uniform or at another club's events
  • Tournament records, league standings, or match scorecards listing the player under another organization
  • Direct observation by Strikers coaching staff or credible reports from third parties
  • The player's or parent's own admission or disclosure

4.3 Good Faith Investigation

Before taking action on a suspected violation, Strikers will:

  • Notify the parent/guardian of the suspected violation in writing
  • Provide the parent/guardian with a reasonable opportunity (no less than 5 business days) to respond and explain the circumstances
  • Consider the parent/guardian's response before making a final determination

5. CONSEQUENCES OF VIOLATION

5.1 Immediate Termination Right

If Strikers Cricket Academy determines, in its sole discretion, that a player has violated this exclusivity commitment, Strikers reserves the right to:

  • Terminate the player's membership immediately without further notice
  • Remove the player from all Strikers teams, rosters, and programs effective immediately
  • Revoke access to all Strikers sessions, tournaments, events, and facilities

5.2 No Refund Upon Termination

If membership is terminated due to a violation of this exclusivity commitment:

  • No refund will be provided for the current membership period or any portion thereof
  • No partial refund will be provided for remaining days, weeks, or months in the membership period
  • No credit will be issued toward future membership or enrollment
  • Any prepaid tournament fees, registration fees, or other charges related to the membership are forfeited

5.3 Additional Consequences

In addition to termination and forfeiture of fees, Strikers may:

  • Remove the player from any upcoming tournament rosters or match lineups
  • Notify tournament organizers or league officials of the player's ineligibility to represent Strikers
  • Decline to provide references, recommendations, or player evaluation reports to other organizations

6. RE-APPLICATION AFTER TERMINATION

6.1 Cooling-Off Period

A player whose membership has been terminated for violation of this exclusivity commitment may re-apply to join Strikers Cricket Academy after a cooling-off period. The length of the cooling-off period shall be determined by Strikers at its sole discretion, but shall be no less than 3 months from the date of termination.

6.2 Re-Application Process

Re-application after the cooling-off period is subject to:

  • Availability of spots in the player's age group and program level
  • Review and approval by Strikers coaching staff and administration
  • Payment of any applicable registration fees and membership dues at current rates (no grandfathering of prior pricing)
  • Execution of a new enrollment agreement, including a new exclusivity commitment
  • Any additional conditions Strikers may require at its discretion

6.3 No Guarantee of Re-Admission

Strikers Cricket Academy is under no obligation to re-admit a player who has been terminated for violating this exclusivity commitment. Re-application does not guarantee acceptance. The decision to readmit a player is at Strikers' sole and absolute discretion.


7. WHY WE REQUIRE EXCLUSIVITY

We believe in being transparent about why this policy exists. Strikers Cricket Academy requires exclusivity because:

  • We invest in every player's development. Our coaches build personalized development plans, track progress over seasons, and design training around each player's growth. That investment only makes sense when the player is fully committed to our program.
  • Team cohesion requires commitment. Cricket is a team sport. When players split their time between clubs, it disrupts team chemistry, affects selection fairness, and undermines the players who are fully committed.
  • Tournament integrity matters. We plan tournament rosters months in advance. A player who is also committed to another club creates scheduling conflicts and roster uncertainty that affects the entire team.
  • It protects the community we're building. Our families, coaches, and players are building something together. Exclusivity ensures that everyone in the program is rowing in the same direction.

8. DURATION OF COMMITMENT

8.1 Term

This exclusivity commitment is in effect for the entire duration of your child's membership at Strikers Cricket Academy, from the date of enrollment until the membership is terminated by either party in accordance with the Payment Terms and Membership Agreement.

8.2 Termination of Commitment

This exclusivity commitment ends when:

  • Your child's membership is canceled by you in accordance with the cancellation procedures in the Payment Terms
  • Your child's membership is terminated by Strikers for any reason
  • Your child's membership lapses due to non-payment and is not reactivated

Once the membership ends, the player is free to join any other cricket club, academy, or program without restriction.


9. CALIFORNIA-SPECIFIC PROVISIONS

9.1 Minors' Rights Under California Law

I acknowledge and understand that under California law:

  • As a parent or guardian, I have the legal authority to enter into this agreement on behalf of my minor child
  • This agreement applies only during the period of active membership and does not restrict my child's activities after membership ends
  • My child may have independent rights upon reaching age 18, at which point they may choose to continue or terminate their membership

9.2 Reasonableness of Restrictions

I acknowledge that the exclusivity requirements in this agreement are reasonable in scope and duration because:

  • The restriction applies only to organized competitive cricket clubs and academies, not to recreational or school play
  • The restriction is limited to the duration of active membership and ends immediately upon cancellation
  • The restriction exists to protect Strikers' legitimate business interests in team development, tournament planning, and coaching investment
  • I am free to cancel my child's membership at any time with 14 days notice, thereby ending this exclusivity commitment

9.3 Governing Law

This agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.

9.4 Jurisdiction and Venue

Any legal action, suit, or proceeding arising out of or relating to this agreement shall be brought exclusively in the state or federal courts located in Santa Clara County, California. I consent to the jurisdiction of such courts and waive any objection to venue in such courts.


10. GENERAL PROVISIONS

10.1 Entire Agreement

This Exclusivity Commitment, together with the Liability Waiver, Payment Terms, and Photo/Video Consent, constitutes the entire agreement between me and Strikers Cricket Academy regarding player representation and supersedes any prior oral or written agreements on this subject.

10.2 Modification

This agreement may only be modified in writing and signed by both parties. Strikers Cricket Academy may update this agreement from time to time with 30 days notice, and continued membership after updates constitutes acceptance of updated terms.

10.3 Severability

If any provision of this agreement is found to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall remain in full force and effect.

10.4 Waiver of Provisions

The failure of Strikers Cricket Academy to enforce any provision of this agreement shall not constitute a waiver of that or any other provision. Any waiver of a specific violation does not constitute a waiver of future violations of the same or different provisions.

10.5 Binding Effect

This agreement shall be binding upon me, my child, and our respective heirs, executors, administrators, successors, and assigns for the duration of the membership.


11. ACKNOWLEDGMENT OF UNDERSTANDING

I HAVE CAREFULLY READ THIS EXCLUSIVITY COMMITMENT AND FULLY UNDERSTAND ITS CONTENTS. I understand that:

  • My child must represent Strikers Cricket Academy exclusively while enrolled
  • My child may not train with, compete for, or represent another cricket club or academy during their membership
  • Casual play with friends, school teams, and governing body representative programs are permitted
  • I must notify Strikers if my child receives invitations to play for other organizations
  • Strikers has sole discretion in determining whether a violation has occurred
  • Violation may result in immediate membership termination without refund
  • No partial refund will be provided for any remaining membership period
  • My child may re-apply after a cooling-off period, but re-admission is not guaranteed
  • This commitment ends when membership ends — my child is free to join any program after cancellation
  • I have had the opportunity to ask questions and seek advice before agreeing
  • I am signing this document of my own free will without any pressure or coercion
